Entegris, Inc. announced on December 2, 2024, that it has reached a settlement in a patent lawsuit with DuPont de Nemours, Inc. and its subsidiaries. The lawsuit centered on a fundamental patent protecting Entegris's chemical mechanical planarization (CMP) slurries, which are critical materials used in semiconductor manufacturing. This resolution removes ongoing legal uncertainty for the company.
Under the terms of the settlement, both Entegris's infringement claims in Delaware District Court and DuPont's counterclaims challenging the patent's validity have been dismissed. Crucially, the exclusion order and cease and desist orders previously granted by the U.S. International Trade Commission in 2022 remain in effect. These orders prevent DuPont from importing or distributing its Optiplane 2300 and Optiplane 2600 dielectric CMP slurries in the U.S. market.
Dann Woodland, Senior Vice President and President of Entegris's Materials Solutions division, stated that the company is pleased with the settlement. The continuation of the ITC orders reinforces Entegris's competitive position in the U.S. market for advanced CMP slurries, ensuring protection for its proprietary technology and market share.
