California Establishes Statewide PFAS Regulatory Enforcement Program

On September 29 and 30, 2024, California Governor Gavin Newsom signed Assembly Bill (AB) 347 and AB 2515, initiating a statewide regulatory enforcement program for per- and polyfluoroalkyl substances (PFAS). These bills direct the Department of Toxic Substances Control (DTSC) to adopt regulations and publish acceptable testing methods for PFAS found in juvenile products, textile articles, food packaging, and menstrual products. Manufacturers of these affected products will be required to register with the DTSC, pay a fee, and provide compliance certification by July 1, 2029. Enforcement of these new regulations is slated to commence in July 2030, marking a significant shift in product safety and environmental compliance within the state. The legislation aims to enhance the enforcement of existing restrictions and establish new limits for PFAS, creating potential challenges for manufacturers regarding testing, increased liability, and compliance expenses.
