Court Rejects Holley's Motion to Amend Disgorgement Order, Upholds $2 Million Payment

On March 27, 2024, the United States District Court for the Western District of Kentucky issued a judgment ordering Holley Performance Products, Inc. to disgorge $2,028,264.19 in net profit to Specialty Auto Parts U.S.A., Inc. This payment is for sales of Ultra Aluminum HP carburetors that violated a 2001 Settlement Agreement. The Court determined that Holley at least recklessly violated the Settlement Agreement by branding the carburetor as an 'HP' product. On March 24, 2025, the Court rejected Holley’s motion to alter or amend this disgorgement judgment, concluding that Holley failed to demonstrate clear error in the court's decision. Holley was given ten days to post a supersedeas bond in the amount of $2,231,090.61, which includes the original judgment amount and approximate post-judgment interest.
