Meta’s WhatsApp Data‑Sharing Ban Lifted by Indian Tribunal, Fine Upheld

The National Company Law Appellate Tribunal (NCLAT) overturned the Competition Commission of India’s five‑year ban on WhatsApp sharing user data with other Meta entities for advertising purposes. The tribunal also upheld the CCI’s fine of INR 2.13 billion (about $25.4 million).

The ban stemmed from a 2021 privacy‑policy update that required WhatsApp users to accept expanded data sharing with Meta companies. The CCI found that this “take‑it‑or‑leave‑it” approach constituted an abuse of Meta’s dominant position and created barriers for competitors in India’s display‑advertising market. The NCLAT noted that the original rationale for the ban was missing and that restoring user consent and opt‑in/opt‑out choices would address the coercive elements of the policy.
